Road Accidents
If you have been injured in a road traffic accident as a pedestrian, driver or passenger and it was not your fault, we could help you claim compensation. If the driver who caused the accident was uninsured it is still possible to make a claim to the Motor Insurers Bureau.
Work Accidents Accidents at work can happen for a variety of reasons. The workplace is a potentially dangerous place and there is a duty on the Employer to make sure that accidents do not occur and that Employees are not injured whilst at work.
One important point to mention is that your Employer cannot dismiss you if you make a personal injury claim.Your Employer should, in fact, be insured against accidents and the insurers will deal with the claim.
If you have to have time off work as a result of the accident and are not paid by your employer you can include as part of your claim, a claim for loss of earnings.
Hazards
Sippery floors, dangerous unsecured cables, banding or obstacles left in the aisles, exposure to noise or fumes could all result in an Employee sustaining injury (and it may be possible to make a claim).
Inadequate Training
An accident could occur as a result of an Employee or colleague not being adequately trained. If you have not been trained how to lift properly or how to use machinery you may be able to make a claim.
Repetitive Strain Injury
If you have to carry out repetitive tasks it is possible that you may suffer from injuries to hands wrists and elbows. If you suffer with such a condition you may be entitled to compensation, if your condition has been caused at work.
Deafness, Industrial Disease
If your hearing has been affected due to exposure of noise, or you have suffered with conditions such as dermatitis you may be entitled to compensation if the illness or condition has been caused at work.
Machinery/ Equipment
Machinery or equipment which is defective, worn out or for which you have not had proper training can be potentially dangerous. The onus is on the Employer to make sure that a safe system of work is operated, and therefore if you have sustained an injury it is possible your Employer may be at fault.
Slips, Trips and Falls
Accidents can occur as a result of tripping on potholes or broken paving slaps in public places. Local authorities are under a duty to ensure that footpaths and public areas are kept safe. If you have been injured as a result of a fall which was not your fault you may be able to make a claim.
Public Liability
The owners or occupiers of land or premises are under a duty to ensure that the land or premises are safe for visitors. If you are, for example, visiting a supermarket and you slip on spilt liquid or food, the operator of the supermarket may be liable if they have not taken the necessary steps to ensure that the supermarket was kept clean and free from hazards. Also if you have been injured whilst participating in classes or exercises at a gym due to inadequate training or defective equipment you may be entitled to claim compensation.
Assaults
If you have suffered an injury as a result of an assault you may be entitled to compensation. In these cases a claim, which must generally be made within two years is made to the criminal injuries compensation authority. The person who assaulted you need not necessarily have been convicted for a claim to be made.
Product Liability
If you have been injured by a defective product or suffered a reaction to a substance which has been used as part of a treatment (for example a hair dye) it may be possible to make a claim for compensation.
