- How much will it cost me to make a claim?
We will deal with your claim using an arrangement known as a conditional fee agreement (no win no fee). This means that if you win we recover the costs from the third party insurers and if you lose we do not receive any costs. We will also, if you do not have legal expenses cover (for example on your household or motor insurance, arrange costs insurance cover which is free of charge to you. This will cover the Defendants costs and the expenses if the claim does not succeed. This means that you can make a claim and there is no financial risk to you. (This scheme replaced legal aid which was withdrawn for personal injury claims a few years ago)
- What is the situation if I already have legal expenses cover?
We can carry out a free review of the case. The cover which you have may not give full costs protection, we can arrange alternative cover if necessary.
- If I have been referred to a Solicitor by my legal expenses insurer do I have to use them?
The general rule is that you can use the Solicitor of your choice, quite often the Solicitor who you are referred to will not be local and you may find that you are left on hold or that your calls are not returned. It makes sense to deal with somebody local and if you would like to consider changing Solicitor, please contact us for a free, no obligation review of your claim.
- Do I have to pay expenses (Disbursements) while my claim is being Pursued?
No. We deal with the expenses, for example, Medical Report fees, Court fees.
- Is there a time limit for making my claim?
Yes. A claim must be made within 3 years of the date of the accident or if the person was under 18, within 3 years of their 18th Birthday.
- Can I claim against an uninsured or untraced driver?
Yes. The claim is made to the Motor Insurers Bureau which deals with these types of claim.
- Can I make a claim if I was injured as the result of an assault?
Yes it is possible to make a claim to the Criminal Injuries Compensation Authority.
- Can you visit me at home outside office hours?
Yes we can arrange home visits and can visit you during the evening and at weekends if this is more convenient.
- How much compensation will I receive?
This will depend on how serious your injuries are. Awards can range from £1500 for a whiplash injury to in excess of £15,000 for more serious injuries or multiple injuries. We can also recover loss of earnings (if you are not paid by your employer or only receive basic SSP). And any other expenses which you incur. We can also recover the cost of Private Medical Treatment if this is required.
- Will there be any deductions from my compensation?
No. ‘What you win is what you get’ we do not charge any fees at all (some claims management companies charge a management fee). There are also no loans or other expenses.
- Can I get an account payment?
If liability for your accident is admitted it is possible to obtain a payment on account of your compensation from the third party insurers in certain circumstances.
- When can I make a claim?
If you have been injured at work (we specialize in workplace accidents) on the road, whilst walking on the public highway or in a shop or other public place you may be able to claim if the accident was not your fault. We can carry out a review of your claim entirely free of charge and if we take your case on you will receive 100% of your compensation.
Your claim will be assessed and dealt with by a qualified Solicitor from start to finish.
- Is it possible to claim even if liability is not entirely clear?
Yes, it is possible for a Court to find that a Defendant is to partly blame and that the person claiming (the Claimant) is partly to blame. This principle is known as contributory negligence. Even if the circumstances of the accident are not clear or somebody has tried to persuade you that you are to blame it may still be worth making an enquiry.
